SRC CONSTITUTION


GHANA INSTITUTE OF MANAGEMENT AND PUBLIC ADMINISTRATION (GIMPA) 

STUDENTS’ REPRESENTATIVE COUNCIL (SRC) CONSTITUTION 

       1.         PREAMBLE 

We, the students of Ghana Institute of Management and Public Administration (GIMPA), hereinafter having our Trust in God Almighty, believing that it is through unity that the interest of the student shall be safeguarded, are; 

DETERMINED to establish the dignity of the students, ensure the welfare of the students, ensure discipline amongst students to foster solidarity and fraternity among other sister institutions, desirous of fostering chosen bonds of friendship and responsibility, realizing the need to attain the highest excellence in our moral, spiritual, social, political and intellectual endeavour; IN SOLEMN declaration and affirmation of our commitment in the collective will of the students; 

INTEND to establish accountable student governance, enrich our heritage and safeguard the exquisite principles of probity, veracity, impartiality and scrupulosity; 

RESOLVED to abide by democratic principles and to let our knowledge have liberative effect on all people; 

Do hereby adopt, enact and give to ourselves this Constitution. 

       2.         NAME 

The name of the Association shall be known and called the “GHANA INSTITUTE OF 

       MANAGEMENT      AND       PUBLIC       ADMINISTRATION      (GIMPA)      STUDENTS’

REPRESENTATIVE COUNCIL” herein after called “GIMPA SRC”

CHAPTER ONE 

THE CONSTITUTION ARTICLE 1  NAME 

There shall be formed an organization under this Constitution known and called the Students’ Representative Council of Ghana Institute of Management and Public Administration (GIMPA)hereinafter referred to as the SRC. 

       ARTICLE 2               SUPREMACY OF THE CONSTITUTION 

  1. This Constitution shall be the supreme Constitution of all students, clubs, associations or unions in GIMPA, and any other Constitution found to be inconsistent with any provision of this Constitution shall, to the extent of its inconsistency, be null and void. 
  2. Notwithstanding Article (2) clause (1), this Constitution shall be subject to the Constitution of the Republic of Ghana, Laws of Ghana, and the statute establishing GIMPA. 

       ARTICLE 3               ENFORCEMENT OF THE CONSTITUTION 

  1. Any student who alleges that- 
    1. An act or omission of any person or group of persons or  
    1. A Constitution, decision or resolution of anybody, organization, club, union, or association is in contravention with a provision of this Constitution, may apply to the Judicial Council for a declaration to that effect. 
  2. The Judicial Council shall for the purpose of such declaration under clause (1) of this article make such orders and give such directions as it  may consider appropriate for giving effect, or enabling effect to be given to the directions so made. 
  3. Failure to obey or carryout the terms of an order or direction made or given under clause (2) of this article constitutes a violation of this Constitution and contempt 

of the Judicial Council, and in the case of an Executive Committee member, constitutes a ground for removal from office. 

       ARTICLE 4               RECOGNITION AND AFFILIATION 

  1. The SRC shall be the only legitimate mouth piece of the entire GIMPA students to GIMPA Authorities and outside bodies.
  2. The SRC shall be affiliated to the National Union of Ghana Students (NUGS) and any other organization that does not conflict with the SRC’s objectives.

CHAPTER TWO 

       ARTICLE 5               AIMS AND OBJECTIVES OF THE SRC 

  1. The aims and objectives of the SRC shall include but are not limited to; 
    1. Seeking and pursuing the interest and welfare of Students of GIMPA in particular and students of Ghana in general, and advice on issues concerning students. 
    1. Serve as the mouthpiece of the entire student body of GIMPA. 
    1. Provide means of communication between the students and GIMPA authorities on all matters affecting the student body as a whole or in part thereof. 
    1. Pursue policies that shall be necessary for the attainment of the academic and social standards of GIMPA. 
    1. Co-ordinate with other student organizations in Ghana and internationally on matters of mutual interest. 
    1. Foster good relations between students of GIMPA and the outside world. 
  2. For the purpose of achieving these objects, the SRC shall organize lectures, symposia, debates etc., and such other activities as are necessary to fulfill these general aims and objectives.

CHAPTER THREE 

       ARTICLE 6               COMPOSITION OF THE SRC 

1) The SRC shall be composed of: 

  1. The General Assembly 
  2. The Executive Officers  
  3. The Executive Committee 
  4. The Judicial Council 
  5. All Committees formed under this Constitution or by a resolution of the General Assembly. 
  6. The General Student body, to wit: 
    1. Validly enrolled students of GIMPA; 
    1. Students granted valid academic deferment; 
    1. Any other person so deemed to be a student of GIMPA by the statutes, regulations and decisions of any valid organs of GIMPA. 

       ARTICLE 7               THE GENERAL ASSEMBLY 

  1. There shall be a General Assembly which shall be composed of: 
    1. The Speaker; 
    1. The Clerk; 
    1. Two (2) elected Representatives from each program year group (class); 
    1. Three (3) Local Executives each from the Satellite Campuses;
    1. One (1) Representative each of registered Clubs and Associations; 
    1. Ex-officio members; 
    1. All other Chairpersons of the Committees of the SRC; 
    1. The SRC Secretary who shall take records of all proceedings, but shall not have a casting vote during decision making. 
  2. The SRC Secretary shall within two (2) weeks of assumption of office request in writing to the various bodies concerned, all such members as provided for in paragraph (a) to (h) of clause (1) of this article. 
  3. Any person or body written to by the Secretary shall forward the names of such representatives qualified to be members of the General Assembly by virtue of paragraphs (a) to (h) of clause (1) of this article to the SRC Secretary within seven (7) days after the induction into office of the SRC Executive Officers.  
  4. A General Assembly member shall, before taking his/her seat in the General Assembly, take and subscribe before the Chief Justice, the Oath of Membership of the General Assembly set out in the Fifth Schedule to this Constitution. 

       ARTICLE 8               FIRST GENERAL ASSEMBLY MEETING 

  1. The first General Assembly Meeting shall be held within Fourteen (14) days after the swearing in of the new Executive Officers. 
  2. The SRC President shall be the Chairperson at the start of the first General Assembly meeting and shall administer the oath of General Assembly members.
  3. The President shall appoint a person to the position of The Speaker, subject to the approval of General Assembly.
  4. The SRC President shall administer the oath of the Speaker of General Assembly.
  5. The Speaker shall then resume his/her seat as the Speaker of General Assembly, and the SRC President shall take his seat as the SRC President and not the Chairperson of General Assembly.
  6. The President shall appoint a person to the position of the Clerk of General Assembly.
  7. The Speaker of General Assembly shall steer affairs, as the SRC President appoints the Chief Justice.
  8. After the swearing in of the Chief Justice, formation of Standing Committees shall take off.

       ARTICLE 9               CONVENING OF GENERAL ASSEMBLY MEETINGS 

  1. The General Assembly shall meet at least three (3) times each semester. 
  2. The SRC President in consultation with the Speaker shall convene a General Assembly meeting. 
  3. The General Assembly Clerk shall in writing, or in any other form as may be decided upon by the Executive Committee notify members of such meetings, specifying the Agenda in not less than Ninety-Six (96) hours before the meeting. 
  4. The General Assembly shall be presided over by The Speaker, who shall be appointed by the SRC President in consultation with the other Executive Officers, and in his absence, the Clerk shall act. 
  5. The quorum for a General Assembly meeting shall be: 
    1. The Speaker;
    1. The Clerk;
    1. One-third of elected representatives; 
    1. At least one head of Associations or Clubs. 
  6. a. Decisions at General Assembly meetings shall be determined by a simple  majority of members present and voting. 
    1. Voting shall be done by popular acclamation or otherwise stated by this Constitution. 
    1. Notwithstanding Clause 6(b), any member present and voting, can request for a head count. 

       ARTICLE 10             NOTIFICATIONS FOR GENERAL ASSEMBLY MEETINGS 

  1. General Assembly Members shall be notified of meetings at least Ninety-Six (96) hours before the proposed date for the said meeting.
  2. Notwithstanding clause one (1) above, notices for emergency meetings shall be at least Forty-Eight (48) hours before the said meeting.
  3. Notwithstanding Clauses (1) and (2), all notices for such meetings shall be published with the agenda, for the benefit of the general student body.

       ARTICLE 11             EMERGENCY GENERAL MEETINGS 

  1. Notwithstanding Article 7 (1) of this Constitution, the Executive Committee, or one-third of the General Assembly members, may call for an emergency meeting provided that the notice shall be given in writing duly signed by them, and that the agenda shall be attached and delivered to The Speaker. No other business shall be discussed apart from the attached agenda. 
  2. The Speaker, in consultation with the Executive Committee, shall summon the meeting within Forty-Eight (48) hours upon the receipt of such request. 
  3. The quorum for Emergency General Assembly meeting shall be one-third of the General Assembly members. 
  4. Notwithstanding Clause (1), the SRC President in consultation with the Executive Committee, may call for an emergency meeting when the need be. 

       ARTICLE 12             DECISION MAKING 

  1. The General Assembly shall be the highest decision making body of the SRC. 
  2. The General Assembly may concern itself with questions of general policy referred to it by the Executive Committee of the SRC. 

ARTICLE 13             ATTENDANCE OF OBSERVERS AT GENERAL ASSEMBLY MEETINGS

  1. Observers or a member of any committee who is not a General Assembly member, shall be entitled to participate in the proceedings of the General Assembly, and shall be accorded all privileges of a General Assembly member.
  2. An observer shall not be entitled to vote, and cannot second a motion, or take allowance, if any.
  3. An observer shall be a student of GIMPA.
  4. Notwithstanding clause (3), the General Assembly may invite the audience, and or participation of a non-student, who may not participate in discussions apart from the substantive issue for which the invitation was made.

       ARTICLE 14             CODE OF CONDUCT FOR GENERAL ASSEMBLY MEETINGS

  1. General Assembly members dressing to meetings shall be strictly formal:
    1. Both men and women may wear suit

i. The suit should always look professional, should be kept clean and wrinkle – free. ii. A button-down shirt of any kind is appropriate and should be worn with a tie for men.

  • Both men and women may wear African Prints or traditional wear.
    • Any other formal or traditional attire prescribed by the General Assembly can be worn.
    • Shoe will be worn by both men and women.
    • No T-shirts, shorts, sneakers, Slippers or caps should be worn.
    • Hair should be kept clean and out of face for a professional look.
  • Members unofficially dressed will be seen as naked and shall be walked out of the meeting.
  • The SRC shall provide special costumes for the Speaker, the Clerk and the Chief Justice, which shall be worn to General Assembly meetings always.
    • The costumes provided shall be the sole property of the SRC.
  • The Executive officers and General Assembly members shall be given identity cards or tags identifying them as such. The ID Cards or tags shall be the sole property of the SRC, and shall be issued by the SRC.
  • A member speaking on the floor shall direct his/her speech to the issue under discussion. Every member shall address himself solely to the Speaker.
  • No member shall be allowed to speak more than once on a motion, as long as a member who has not spoken on the motion desires the floor. 
  • The speaker shall interpret and help maintain the standing orders set out in this Constitution.
  • No member shall leave the meeting without the permission of the Speaker.

       ARTICLE 15             TENURE OF OFFICE OF GENERAL ASSEMBLY MEMBERS 

  1. A General Assembly  Member shall vacate his seat in the General Assembly: 
    1. Upon the dissolution of the General Assembly; 
    1. If he is absent for two (2) consecutive sittings in a semester without permission in writing to the Speaker, and is unable to offer a reasonable explanation for his absence; 
    1. If he is expelled from the General Assembly after having been found guilty of contempt by the Disciplinary Committee or the Judicial Council; 
    1. If he resigns from office as a General Assembly member in writing, addressed to the Chairman  of the Judicial Council;
    1. If he is removed from office in accordance with this Constitution 
  2. The General Assembly shall be dissolved by the Outgoing Executive Officers at least Twenty-Four (24) hours prior to the handing over to the new Executive Officers. 

       ARTICLE 16             EXECUTIVE COMMITTEE MEETINGS 

  1. Members of the Executive Committee shall meet at least once in a month.
  2. The President, Secretary, Treasurer and any other four (4) members shall form a quorum.
  3. A simple majority shall be used in the voting process.
  4. The Executive Committee shall make standing orders for its meetings.
  5. The President shall chair all Executive Committee meetings. In his absence, the 

Vice President may chair such meetings, after prior approval from the President

       ARTICLE 17             GENERAL STUDENTS’ MEETINGS 

  1. The SRC shall convene students’ forum for the entire student body at least once a semester, and when the need arises.
  2. At least Forty (40) students, with even representation from each programme, shall form a quorum.
  3. Special forums shall be called at the request of fifty (50) students who shall subscribe their names, student’s identification number, level, program and signatures to the request, stating the purpose of the meeting.
  4. A simple majority shall determine decisions.
  5. Matters of impeachment shall not form the basis for such meetings. Impeachment issues shall be within the domain of the Judicial Council.

CHAPTER FOUR 

THE EXECUTIVE ARTICLE 18        EXECUTIVE COMMITTEE 

  1. There shall be an Executive Committee which shall consist of: 
    1. The elected Executive Officers ; 
    1. All Committee Chairpersons, except the Chairpersons of the Judicial Council, The Electoral Commission, the Audit Committee, the Appeals Board and all other Adhoc Committees; 
    1. The SRC Legal advisor;
    1. One (1) Local Executive each from the Satellite Campuses 
  2. Members of the Executive Committee shall assist and counsel the Executive Officers in the performance of their duties and see to the implementation of the decisions of the General Assembly. 
  3. The quorum for Executive Committee meetings shall be Seven (7), including the President or the Vice and the Secretary or the Treasurer. 
  4. The Executive Committee shall in times of emergency, have powers to promptly meet without prejudice to any provisions of this Constitution, provided that the Executive Committee shall report their actions to the General Assembly as soon as possible through any appropriate medium and at its subsequent meeting for ratification. 
  5. The Executive Committee shall formulate policies of the SRC and refer same to the General Assembly for consideration. No policy so formulated shall be valid without the approval of the General Assembly. 
  6. The Executive Committee member(s) before assuming office, shall take and subscribe to the Executive Committee Oath set out in the fourth Schedule to this Constitution to be administered by the Chairperson of the Judicial Council, either at a public gathering, at the first General Assembly meeting, or any other general meetings of the General Assembly. 

       ARTICLE 19             FORA AND PRESS CONFERENCES 

  1. The Executive Committee shall hold at least one (1) forum in each semester. 
    1. The forum shall be composed of the student body and GIMPA authorities. 
    1. Other persons may be invited to the forum as may be determined by the General Assembly. 
  2. Notwithstanding Clause (1) of this article, any thirty (30) students, three (3) from each programme, may request for an emergency forum to discuss pertinent issues affecting the general student body. 
  3. The Executive Committee may hold at least one (1) press conference in each semester. 
  4. The theme for the press conference shall be discussed at the General Assembly before the said date. 

       ARTICLE 20             EXECUTIVE OFFICERS 

  1. There shall be Executive Officers of the SRC which shall consist of: 
    1. The President;  
    1. Vice President;  
    1. Secretary;  
    1. Treasurer; and 
    1. Women’s Commissioner.
  2. The Executive Officers may invite any member or committee to assist or address them in any deliberations in relation to the performance of their functions. 
  3. The quorum for Executive Officers meeting shall be three (3) including the President or the Vice and the Secretary. 
    1. In the absence of the President, the Vice President may chair Executive Committee Meetings, with prior consent of the President. 
  4. The Executive Officers shall in times of emergency, have powers to promptly meet without prejudice to any provisions of this Constitution, provided that the 

Executive Officers shall report their actions to the General Assembly as soon as 

possible through any appropriate medium and at its subsequent meeting for ratification.  

  • They shall be in charge of organizing all approved programmes by the General Assembly that shall ensure the smooth running of the GIMPA SRC. 
  • They shall have the powers to determine the annual subscription (SRC dues) to be paid by each student and its mode of payment subject to the approval of General Assembly. 
  • They shall implement any provision of the GIMPA SRC Constitution. 
  • They shall be the main implementing body of the decisions of the General Assembly, unless otherwise stated. 
  • They shall be the sole body to make presentations to GIMPA authorities on behalf of the entire students of GIMPA. 
  • They shall have the powers to issue Executive instruments. 

ARTICLE 21      DUTIES OF EXECUTIVE OFFICERS 1) THE PRESIDENT 

  1. There shall be a President who shall be the chief spokesperson of all students of GIMPA. 
  2. Before assuming office, the President shall take and subscribe before the Chief Justice and the general student body, the Presidential Oath set out in the First Schedule to this Constitution. 
  3. The authority of the President shall extend to the execution and maintenance of all provisions, including article 5 of this Constitution. 
  4. The President shall not be personally liable to proceedings in any court for the performance of his functions, or for any act of omission or commission in the performance of his functions, under this Constitution. 
  5. The President shall appoint the Speaker, Chief Justice, and all heads of standing committees of the SRC subject to the approval of the General Assembly, in consultation with the other Executive Officers, except in the case of the Electoral Commissioner, or otherwise stated in this Constitution. 
  6. Assign any extra duty to any of the SRC Executive Committee members. 
  7. Shall cast a vote where there is a tie on a decision at the Executive Officers and Executive Committee meetings. 
  8. Shall deliver the State of Affairs of the SRC to the General Assembly at the beginning of each semester and at the dissolution of General Assembly. 
  9. Shall be the principal signatory to all GIMPA SRC bank account(s). 
  10. Shall approve all monies released by the SRC Treasurer. 
  11. Shall, together with the Executive Secretary, sign all minutes of SRC Executive Committee meetings. 
  12. Shall, with the Secretary, sign all letters going out of the SRC’s office. 
  13. Shall attend GIMPA Management and GIMPA Governing Council Meetings on behalf of GIMPA students. 
  14. Shall cause to be prepared and presented to the General Assembly at the beginning of each semester, estimates of revenues and expenditure of the SRC or committees of the General Assembly for that semester. 
  15. Shall within twenty-one (21) days after assumption of office, present to the General Assembly, the proposed programmes or projects to be undertaken by the Executive Committee during their tenure of office. 
  16. For the purpose of Clause (o) above, the General Assembly shall meet and deliberate on the viability or otherwise of such programmes or projects before authorizing the allocation of funds for it from the SRC fund. 

i. The General Assembly shall have the powers to modify the terms of any contract so presented. 

2) THE VICE PRESIDENT 

  1. Shall before assuming office, take and subscribe before the general student body, the Presidential Oath set out in the First Schedule to this Constitution.
  2. Shall act in the absence of the President and have all the powers and prerogatives of the President.
  3. Shall assist the President in the performance of his/her duties.
  4. Shall perform such other duties assigned to him/her by the President or the Executive Committee.
  5. Shall represent SRC on GIMPA Academic Board Meetings.
  6. Shall be an ex-officio member to any Standing Committee of the SRC except the Electoral Commission, the Judicial Council and the Appeals Board.

3) THE SECRETARY 

  1. There shall be a Secretary who shall be the Secretary to the SRC.
  2. Shall summon SRC Executive Committee meetings under the direction of the SRC President.
  3. The Secretary shall perform duties and functions which shall include:
    1. Keeping and maintaining true and accurate minutes and records of all proceedings of the General Assembly, the Executive Committee and the Executive Officers’ meetings.
    1. Responsible for both internal and external correspondences of the SRC.
    1. Compilation of an official list of all members of the General Assembly in accordance with the provisions of this Constitution.
    1. The performance of other duties as may be assigned from time to time by the President, or the General Assembly.
  4. Shall in consultation with the Speaker of the General assembly, serve notices for General Assembly meetings.
  5. Before assuming office, the Secretary shall take and subscribe before the Chief Justice, and the general student body at a public gathering, the executive officers’ oath set out in the Third Schedule to this Constitution.

4) THE VICE SECRETARY 

  1. There shall be a Vice Secretary who shall be appointed by the Executive Officers, subject to the approval of General Assembly.
  2. The Vice Secretary shall act in the absence of the SRC Secretary.
  3. Shall perform other duties assigned to him by the President, the Secretary, the Executive Committee, or the General Assembly. 
  4. The Vice Secretary shall, before assuming office, swear the oath of the office of the Secretary, set out in the Third Schedule to this Constitution.

5) THE TREASURER 

  1. Shall be responsible for all financial transactions of the SRC in conjunction with the Finance Committee.
  2. Shall take custody and be in charge of all SRC bank Cheque books, ledgers, cash books, receipts and invoices.
  3. Shall keep proper records of dues or subscriptions collected for or on behalf of the SRC from GIMPA authorities.
  4. Shall be a signatory to the SRC’s Bank Account.
  5. Shall be responsible for presenting Annual Budgets to the General Assembly at the beginning of each semester for approval.
  6. The Treasurer shall be the secretary to the Finance Committee and shall perform such duties in relation to the Finance Committee as provided in this Constitution.
  7. Shall submit all accounts of SRC to the auditors appointed by the General Assembly.
  8. Shall present financial statements to the General Assembly in every semester.
  9. The Treasurer shall, before assuming office, take and subscribe before the general student body at a public gathering, the Treasurer’s Oath, set out in the Fourth schedule to this Constitution.

6) WOMEN’S COMMISSIONER 

  1. Shall be responsible for organizing SRC women’s programs and activities. 
  2. Shall instill in female students an understanding of the need to belong to and participate in students’ governance and other campus programs. 
  3. Shall assist in administering first aid to female students on campus. 
  4. Shall chair the Women’s Parliament on campus. 
  5. Shall be the link between female students on GIMPA campus and other groups or female groups from sister institutions. 
  6. Shall present a proposal to the Executive Committee at the beginning of each semester, outlining the activities the Women’s Commission wants to undertake. 
  7. Shall perform any other duties assigned to her by the SRC President, Executive Committee or General Assembly. 
  8. Before assuming office, the Women’s Commissioner shall take and subscribe before the Chief Justice, and the general student body at a public gathering, the executive officers’ oath set out in the Third Schedule to this Constitution. 

       ARTICLE 22             THE SPEAKER

  1. There shall be a Speaker of the General Assembly who shall moderate proceedings of the House.  
  2. The Speaker shall be appointed by the President in consultation with the Executive Officers, subject to the approval of General Assembly. 
  3. The Speaker shall have the power to determine who speaks on an issue under discussion and at what time. 
  4. The Speaker shall not be a level hundred (100) undergraduate student. 
  5. The Speaker must be a General Assembly member for at least two semesters prior to his or her appointment. 
  6. The Speaker must be of high moral character and reputation. 

       ARTICLE 23             THE CLERK

  1. There shall be a Clerk of the General Assembly who shall be responsible for all correspondences on all General Assembly activities. 
  2. The Clerk shall be appointed by the President, subject to the approval of General Assembly. 
  3. The Clerk must be a General Assembly Member for at least two Semesters prior to his or her appointment. 
  4. The Clerk shall in writing, or in any other form as may be decided upon by the 

Executive Committee and the Speaker, notify members of, General Assembly, and Emergency meetings. 

  • The Clerk shall be the note-taker during General Assembly meetings. 
  • The Clerk shall act in the absence of the Speaker. 

       ARTICLE 24             THE SATELLITE CAMPUSES

  1. The Satellite campuses of this institution shall elect their local executives to run their affairs at the various campuses.
  2. Three of the elected Local SRC Executives:
    1. The Local President; 
    1. Local Secretary; and  
    1. Local Treasurer;  

Shall represent the Satellite campuses at the General Assembly as their Coordinators.

  • The Coordinators will be the mouthpiece of the Students of the Satellite campuses.  
  • These Coordinators shall manage the affairs of the Local SRC at their various campuses.
  • The President of the local executives shall be a member of the Executive Committee of the SRC.
  • The Satellite Campuses will prepare their budgets and give it to the Finance Committee, which shall then be captured in the main SRC budget for approval by the General Assembly.
  • A ratio determined by the Finance Committee based on the dues subscription of the said Satellite Campus will be allocated to the respective campus.
  • The Satellite Campuses will manage their own accounts of the monies that shall be allocated to them by the main SRC.
  • The leadership of the Satellite Campus will be accountable for any monies allocated to them by the SRC.
  • In terms of conflicts and any other issues of students which are beyond the leadership of the Satellite Campus, the matter will be referred to the leadership of the main SRC. 

CHAPTER FIVE 

COMMITTEES OF THE SRC ARTICLE 25            COMMITTEES

  1. Committees shall be formed as may be necessary for the effective running of the SRC.
  2. The SRC President shall appoint the Heads of the Committees in consultation with the other Executive Officers.
  3. The Executive Officers shall appoint members of the Committees except otherwise stated in this Constitution.
  4. All appointments shall be subject to the approval of the General Assembly.
  5. Each Committee shall be made up of five members including the Chairman, except otherwise stated in this Constitution. 
  6. All Committees shall be charged with such functions assigned by this Constitution, or may be determined by a resolution of or any other decision of the General Assembly.
  7. Every Committee shall present a written report to the General Assembly at least once in a semester.
  8. Every Committee shall, subject to the provisions of this Constitution or a resolution of the General Assembly, regulate its own procedures for its activities, and shall not be inconsistent with the provisions of this Constitution. 
  9. A person appointed to any Committee or Office who:
    1. Misappropriates any fund; 
    1. Conducts himself in such a manner as to cause depreciation whether in respect of loss or otherwise, in any cash property entrusted to him/her:  

a) Shall be liable to make good the loss or be liable to any punishment to be prescribed by the Judicial Council.

  1. The Committees of the SRC are:
    1. The Judicial Council 
    1. The Appeals Board  
    1. The Disciplinary Committee  
    1. The Finance Committee 
    1. The Audit Committee 
    1. Women’s Commission 
    1. The Publication and Information Committee 
    1. The Social and Planning Committee 
    1. The Welfare Committee 
    1. The Procurement Committee 
    1. The Projects and Assets Committee  
    1. The Electoral Commission 
    1. The Transition Committee  
    1. All other Adhoc Committees
  2. The respective appointments are: 
    1. The Speaker
    1. The Chief Justice 
    1. The Electoral Commissioner 
    1. The Clerk
    1. Vice Secretary 
    1. The Legal Advisor 
      1. He should have a legal background either professionally; and or 
      1. Must be an undergraduate law student of GIMPA. 

g. All Heads of Committees of the SRC, not stated in Article 25, Clause (11). 

       ARTICLE 26             JUDICIAL COUNCIL  

  1. There shall be a Judicial Council formed by the SRC.
  2. It shall be made up of five (5) members:
    1. The Chief Justice:
      1. Who shall be the Chairperson of the Council; 
      1. Must be an undergraduate law student of GIMPA; and
      1. Shall be appointed by the SRC President in consultation with the other Executive Officers subject to the approval of General Assembly.
    1. Four other members:
      1. At least, two (2) of the Justices shall be undergraduate Law students of 

GIMPA.

  • Two other Justices may be undergraduate law students or from other schools of GIMPA.
    • Members of the Judicial Council shall possess untarnished record, and will be of high moral character and proven integrity.
    • The work of the Judicial Council shall not be subject to the interference, control, or discretion, of any person, authority, or any party:

(iii) It shall be subject to the SRC Constitution only.

b) Members of the Judicial Council shall not be apt to any suit for any lapse in the execution of their duties.

       ARTICLE 27             JURISDICTION OF THE JUDICIAL COUNCIL  

  1. The Judicial Council shall have the mandate to resolve conflicts between students or groups of students.  
  2. It shall have the sole jurisdiction over all petitions lodged with the Electoral Commission.
  3. The Judicial Council shall have the power to prescribe appropriate punishments for all students and Executives who are found guilty of indiscipline behaviour and having shown disregard for the SRC Constitution, provided that punishments so prescribed shall be capable of being enforced by the SRC.
  4. It shall have jurisdiction over all impeachment proceedings leveled against any Executive member.
  5. It shall have the power to give advisory opinions to the Executive Committee and General Assembly on any legal issue.
  6. Without prejudice to any provision in this Constitution, the decisions of the Judicial Council on matters of interpretation of the SRC Constitution shall be final and conclusive.
  7. In the exercise of its functions, the Judicial Council shall be guided by the Constitution of the SRC, the Statutes establishing GIMPA, the laws of Ghana, and the Constitution of the Republic of Ghana.

       ARTICLE 28             MODE OF EXERCISING JUDICIAL POWERS  

  1. The Judicial Council shall in the exercise of its functions, be bound to give written reasons for its decisions on all matters.  
  2. Unless specifically provided to the contrary, the decisions of the Judicial Council shall be by simple majority. 
  3. The Chief Justice shall preside at all sittings of the Judicial Council, in his/her absence, a member nominated by the Chief Justice, shall act. 
  4. Except in impeachment proceedings, the Judicial Council shall be duly constituted for its work by not less than three (3) members including the Chief Justice. 

       ARTICLE 29             TENURE OF JUDICIAL COUNCIL MEMBERS 

  1. Members of the Judicial Council shall hold office for a period of one (1) year.
  2. Without prejudice to clause (1) of this article, the term of office of the Judicial

Council members, shall expire five (5) days after the sitting of the First (1st) General Assembly, and when the General Assembly approves the nomination and subsequent swearing in of the new Chief Justice.

  • Pursuant to Clause (1) of this article, the out-going members of the Judicial Council including the Chairperson shall hand-over to the new members of the Judicial Council within five days after the approval of the new Chief Justice.
  • The Chairperson and other members of the Judicial Council shall before assuming office, take and subscribe to the Judicial Oath, as provided for in the Schedule to this Constitution before the General Assembly at a sitting called for that purpose.
  • A member of the Judicial Council shall cease to hold office if
    • He or she ceases to be a bona fide student of the School;
    • He or she resigns by writing signed by him or her and addressed to the Executive Committee, through the President provided that at least a twentyone (21) day notice is given;
    • He or she is unable to perform the functions of his or her office whether arising from infirmity of body or mind;
    • For stated misbehaviour or incompetence, provided that in (c) and (d) above, the member against whom the petition is made is entitled to be heard in his defence by himself or by a counsel before the Appeals Board.

       ARTICLE 30             THE APPEALS BOARD 

  1. Without prejudice to any provision of this Constitution, an appeal shall lie as of right from Judgment or order of the Judicial Council to the Appeals Board, whose decision shall be final.
  2. The Appeals Board shall consist of:
    1. The Director of Student Affairs;
    1. The Deputy Registrar of GIMPA or his or her appointed Representative;
    1. The Chairperson of the Judicial Council;
    1. Any two students appointed by the SRC President.
  3. The Appeals Board shall be chaired by the Director of Student Affairs.
  4. The decisions of the Board shall be by a simple majority.
  5. The Board shall be bound to give written reason(s) for its decisions.
  6. Any person appearing before the Appeals Board shall have a right to counsel.  

       ARTICLE 31            DISCIPLINARY COMMITTEE 

  1. There shall be a Disciplinary Committee which shall have the power to deal with all acts of indiscipline on the part of any General Assembly member or student referred to it by the General Assembly, the Speaker, or any member of the Executive Committee.
  2. The Disciplinary Committee shall, in the exercise of its functions, have the power to prescribe appropriate punishments capable of being enforced by the General Assembly.
  3. Notwithstanding any provisions to the contrary, the General Assembly shall, acting on the advice of the Disciplinary Committee, have the power to recommend appropriate punishments to the Dean of Students of the faculty, the Registrar or the Rector for implementation, except where the recommendation of the Disciplinary Committee is 

on appeal at the Judicial Council. 

  • The Disciplinary Committee shall not be subject to the direction or authority of any person or groups of persons in the exercise of its duties.

       ARTICLE 32            FINANCE COMMITTEE 

  1. There shall be a Finance Committee which shall pre-audit all financial transactions of the Executive Officers, Executive Committee or any other Commission or Committee of the SRC. 
  2. The Finance Committee shall comprise: 

a. The Finance Committee Chairperson who shall be appointed by the SRC 

President 

i. The Chairperson shall be a member of the Procurement Committee 

  • The Treasurer who shall be the Secretary of the Committee. 
  • Three (3) other members who shall be appointed by the Executive Officers provided such persons are reading BSc Accounting or BSc Finance in the School. 
  • The Finance Committee, in consultation with the Audit Board shall inform the General Student Body by publishing on Notice Boards, details of all financial transactions of the SRC or Commissions or Committees of the General Assembly in the preceding semester.
  • Shall prepare and review SRC annual budgets. 
  • Shall endorse all capital expenditure of SRC projects which have been passed by General Assembly. 
  • Shall be responsible for preparing all financial statements of the SRC. 
  • Shall control all business ventures of the SRC. 
  • Shall be responsible for seeking sponsorships for the SRC. 
  • Shall determine the honorarium to be given to the Executive Officers as vacation residence fees, including cost of meals and other living expenses, and the sitting allowances of all Committee members. 
  • Shall determine the honorarium to be given to the Executive Committee members, who may, during vacation, be required to stay on campus to execute the programmes and projects of the SRC, subject to the approval of General Assembly. 
  • Shall ensure the allocation of funds to various SRC activities, encourage and promote the efficient utilization of the resources of the SRC through effective and efficient financial measures. 
  • The quorum for Finance Committee meetings shall be two-thirds (2/3) of all it members, with the presence of the Chairman or the Secretary. 

       ARTICLE 33            DEFAULTS BY THE FINANCE COMMITTEE 

  1. Subject to clause (3) of this article, where there is a default on the part of the Finance Committee and such default is found by the Judicial Council to be due to the wilful refusal or neglect to comply with any provision of this Constitution, or incompetence, or both, every member of the committee shall cease forthwith to be a member of the SRC Finance Committee.
  2. Where the default is found to have been caused either wholly or in part by any member of the Executive Committee or General Assembly, such a member shall suffer the penalty as may be determined by the Audit Board.
  3. Any person who intentionally or otherwise, fails to comply with the provisions of this chapter shall be liable to account for, or bear any other punishment determined by the Judicial Council, and or prescribed by the General Assembly.

       ARTICLE 34             THE AUDIT COMMITTEE 

  1. There shall be an Audit Committee of the SRC which shall audit all financial transactions and Assets of the SRC. 
  2. The accounts of the SRC and all Committees, Commissions or Institutions established under this Constitution or by a resolution of the General Assembly shall be audited and its dealings reported to the General Assembly by the Chairperson. 
  3. For the purpose of clause (2) of this article, the Chairperson or any person authorized or appointed for such purpose by the Chairperson, shall have access to all books, records, returns and other documents relating or relevant to those accounts. 
  4. Members of the committee shall be Bsc Finance or Bsc Accounting Students only. 
  5. For the purpose of its work, the Audit Committee shall have the legal right to subpoena any person including members of the Executive Committee of the SRC to appear before it. 
  6. Any student who knowingly or recklessly makes an allegation, either orally or in writing to the Audit Committee, of any statement conveying an information or explanation required by the Committee, or to which the Committee is entitled to, which proves to be misleading, false or deceptive, shall be liable to any sanctions approved by the Judicial Council in consultation with the SRC. 

       ARTICLE 35             INDEPENDENCE AND POWERS OF THE AUDIT COMMITTEE 

  1. The Audit Committee: 
    1. Shall not be subject to the direction or control of any person or authority. 
    1. Shall disallow any item of expenditure which is contrary to the provisions of this Constitution or a resolution of the General Assembly, and surcharge – 
      1. The amount of any expenditure disallowed upon the person responsible for incurring or authorizing the expenditure; 
      1. The amount of any loss or deficiency upon any person by whose  negligence or misconduct the loss or deficiency has been incurred; iii) Any sum which has not been duly brought into account, upon the person by whom the sum ought to have been brought into account. 
  2. A person aggrieved by a disallowance or surcharge made by the Audit Committee may appeal to the Judicial Council through the General Assembly. 
  3. Subject to a non – resolution of said grievance by the Judicial Council in Clause 3(2), an appeal shall be made to an Audit Appeals Board consisting of: 
    1. Three (3) students of the Audit Committee; 
    1. Judicial Council representative of the SRC; and 
    1. GIMPA’s Internal Auditor:  

 To further Audit the Accounts in question. 

  • If findings in Clause (3) still prove that there has been a deficiency, the General Assembly shall by a resolution, request the Central Administration to surcharge, withhold all results, awards, and documents of the person involved, stop him or her from writing examinations if not finished, or dismiss him or her from the institution, whichever appropriate. 

ARTICLE 36    ADMINISTRATIVE EXPENSES OF THE AUDIT COMMITTEE/                   BUDGET

  1. The expenses of the Audit Committee shall be a charge on the SRC Fund. 
  2. The accounts of the Audit Committee and those of the entire SRC shall be received and audited by GIMPA’s Auditor or by a professional/qualified Auditor appointed by the General Assembly, and the findings so made published on the Notice Boards of the students each semester. 

       ARTICLE 37             WOMEN’S COMMISSION 

  1. There shall be a Women’s  Commission which shall be responsible for:
    1. Women’s programs on campus.
    1. The education of GIMPA female students on matters affecting them.
    1. Serving as a link between female students and other groups with the view of sharing ideas and strategies on issues concerning women.
    1. Inculcating in the female students, a sense of inclusion, solidarity and active participation in campus activities.
    1. Improving and strengthening communication and co-operation between the sexes.
  2. The Women’s Commission shall comprise:
    1. The SRC Women’s Commissioner, who shall be the Chairperson.
    1. Four (4) other ladies nominated from the General Assembly.

i) The four ladies must be from level 100 to 400 respectively.

  • The Women’s Commission shall be responsible for the Women’s Parliament, which shall be represented by one representative appointed by the female students of each programme of study. 
    • The Women’s Parliament shall meet at least twice a semester to discuss issues pertaining to the welfare of women. 
    • A report will be submitted to the General Assembly for further action to be taken. 
  • The Commission shall, at the beginning of each semester, present proposals of activities and the expenditures involved to the General Assembly for consideration and approval. 

       ARTICLE 38            PUBLICATIONS AND INFORMATION COMMITTEE 

  1. There shall be a Publication and Information Committee which shall be charged with the responsibility of publishing magazines, newsletters and other SRC handouts. 
  2. The said magazine shall be published at least once every year. 
  3. The magazine shall be sold to students and the general public at a price to be fixed by the Finance Committee with approval from General Assembly. 
  4. All publicity and advertisements of the SRC shall fall within the functions of this committee. 
  5. The composition of the Publication and Information Committee shall be: 
    1. The Editor-In-Chief who shall be the Chairperson of the Committee and shall be appointed by the SRC President
    1. Two (2) editors, of which one must have a professional communications background. 
    1. The SRC Legal Adviser
    1. Cartoonist
    1. Treasurer
    1. One member from each Faculty
  6. The Chairperson shall be the Press Secretary to the SRC, and shall oversee all public relations issues of the SRC including preparations or arrangements for Press Conferences and the release of relevant information required by the General Student body, as the Executive Committee may direct. 
  7. The Committee shall, at the beginning of every semester, notify the General Student body of all vacancies in the General Assembly as provided for in this Constitution of which the students are required to elect their Representatives to that effect. 
  8. The Committee shall be responsible for the external affairs of the SRC and the coordination of the SRC’s relationship with NUGS, and other organizations or 

Institutions.

       ARTICLE 39            SOCIAL AND PLANNING COMMITTEE

  1. There shall be a Social and Planning Committee which shall oversee the organization of all SRC Sports and entertainment activities on campus. 
  2. The Committee shall prepare sports and entertainment schedules at the beginning of each semester provided that prior invitation is extended to the students on the programs outlined. 
  3. The Committee shall render proper accounts of all proceeds accruing to the SRC Finance Committee. Such funds will be paid into the SRC fund. 
  4. The Committee shall consist of one representative each from the various faculties.  

       ARTICLE 40            WELFARE COMMITTEE 

  1. There shall be a Welfare Committee of the SRC to recommend appropriate health delivery system on the school’s premises and assist in implementing any programme in this direction. 
  2. It shall plan clean-up schedules involving the Various Faculties. 
  3. It shall liaise with the relevant committees on matters relating to the sale of food item on campus and monitor the sanitation conditions of such places.  
  4. It shall be responsible for all transport matters and services patronized by students. 
  5. It shall be responsible for the organization of Students’ travels within and outside Ghana. 
  6. It shall liaise with religious bodies on campus on all matters concerning religion. 
  7. The SRC shall recognize all Religious Bodies on Campus: 
    1. Each Religious body shall submit a copy of its Constitution to the SRC, clearly stating its aims and objectives. 
    1. The SRC shall not discriminate against any approved religious body.  All approved religious bodies shall have equal rights. 
    1. All religious bodies shall operate with due regard to the provisions of this Constitution and the General GIMPA Laws and the Constitution of Ghana. 
  8. The Committee shall advise the SRC on students’ academic matters, pertaining to the nature of teaching, research and content of courses, conduct of examination, vacation training, the availability of study aids and equipment etc. 
  9. The Committee shall advice the Executive Committee periodically on all issues affecting students. 
  10. The Committee shall assist the Disciplinary Committee in the prevention and resolution of conflicts between and among Students, Programme Associations or the SRC and Management of GIMPA.

       ARTICLE 41             PROCUREMENT COMMITTEE

  1. There shall be a Procurement Committee which shall be responsible for all SRC tender and procurements. 
  2. It shall confirm the range of acceptable costs of items to be procured and match these with the available funds in the approved budget. 
  3. It shall facilitate all contract administration and ensure compliance with all reporting requirements under the Public Procurement Act. 
  4. It shall open tender before the procurement of any asset or equipment of the SRC. 
  5. The composition of the Procurement Committee shall be: 
    1. The  Chairperson, who shall be a Procurement Student; 
    1. The SRC Legal Advisor; 
    1. The Finance Committee Chairperson; and 
    1. Two (2) members nominated from the General Assembly. 

       ARTICLE 42             PROJECTS AND ASSETS COMMITTEE 

  1. There shall be a Projects and Assets Committee which shall be responsible for all SRC Projects and Assets. 
  2. It shall take charge of all Assets and projects of the SRC and shall keep proper and true records of same. 
  3. It shall take charge and implement all major projects of the SRC. 
  4. The Committee shall, within three (3) weeks of appointment of its chair and members, take stock of all assets, take charge of all on-going projects of the SRC, and report to the General Assembly forthwith. 

       ARTICLE 43             ADHOC COMMITTEES 

  1. The General Assembly shall have the powers to create sub or Ad-hoc Committees to deal with any matter in the pursuit of its aims. 
  2. Without prejudice to any provisions of this Constitution, the General Assembly shall have the power to co-opt students from outside the SRC to serve on such Committees and or any faculty standing committee as it deems fit. 

       ARTICLE 44             TRANSITION COMMITTEE 

6) There shall be a transition committee which shall be responsible for the transition of the old executives to the new executives. 7) Its membership shall be composed of: 

  1. The outgoing Executive Committee; 
  2. The incoming Executive Committee; 
  3. Audit Committee Chairperson; 
  4. Finance Committee Chairperson; 
  5. A member from the General Assembly, who shall be the chairperson of the committee. 

CHAPTER SIX 

ELECTORAL COMMISSION AND ELECTIONS  ARTICLE 45              

  1. The Electoral Commission shall be responsible for conducting and supervising all SRC elections. 
  2. The electoral commission shall consist of: 
    1. The Electoral Commissioner, who shall be appointed by the President; 
    1. Four members appointed by the Executive Officers; 
    1. Each of the four members must be from each Level (Level 100-Level 400). 
  3. The Electoral commissioner shall be appointed in the second semester. 
  4. The Electoral Commissioner must meet the eligibility criteria for an Executive Officer position. 

       ARTICLE 46             INDEPENDENCE OF THE SRC ELECTORAL COMMISSION 

  1. Except as provided in this Constitution, or in any other resolution of the General Assembly, the Electoral Commission shall not be subject to the direction or control of any person or authority in the performance of its duties.
  2. The Electoral Commission shall have the power to make rules and by-laws for elections, subject to the approval of General Assembly.

       ARTICLE 47             EXPENSES OF THE ELECTORAL COMMISSION 

  1. The Electoral Commission shall, after the appointment of its chair and members, present a budget through the Finance Committee to the General Assembly for approval within an appreciable time, for the release of funds for its activities.
  2. All proceeds from sale of forms and activities shall be given to the Finance Committee on proper accounts.
  3. Purchase of Nomination forms shall be made through the SRC bank Account.

       ARTICLE 48             CONDUCT OF ELECTIONS 

  1. Students who wish to contest for any position must apply to the Electoral Commission, upon declaration of the respective vacant positions.
  2. All aspiring candidates must conform to all the rules and regulations stated by the Electoral Commission.
  3. Students shall have the right to belong to any student political club or association for the purpose of the elections.
  4. Where at the close of nominations, two or more candidates or group of candidates stand nominated, a candidate shall stand elected if the number of votes cast in his/her favour is fifty percent (50%) plus one vote of the total number of valid votes cast at the election.
  5. Where at the close of nominations, only one candidate is nominated for a particular position, there shall still be election and the candidate unopposed, shall pull more than fifty percent (50%) plus one vote of the total valid votes cast.
  6. The Electoral Commission shall before vetting, publish the list of qualified nominees.
  7. The Electoral Commission shall conduct series of vetting and screening exercises, to which all nominees shall submit themselves accordingly for clearance.
  8. Election rallies and campaigns shall commence after the results of vetting and screening have been published.
  9. Rallies and campaigns shall seize on the eve of voting day. 
  10. The Electoral Commissioner shall submit all results and documents regarding the election to the Chief Justice within Forty-Eight (48) hours after the close of elections.
  11. The Electoral Commissioner shall immediately declare all provisional results, and until such results are challenged, shall declare the final results within SeventyTwo (72) hours after elections.
  12. Where after close of elections no candidate is able to garner the required fifty percent plus one (50% + 1) vote for the position of the President, the Electoral Commission shall organize a run – off within seven (7) days for the two candidates with the highest votes cast, to determine the ultimate winner.
  13. In the event of a tie, fresh elections shall be held for the candidates involved within Seven (7) days.
  14. In the case where there is no candidate for a particular portfolio after close of nominations, the position will be vacant until the Executive Committee in consultation with the General Assembly, nominate a person from the General Assembly with proven moral character and high integrity to occupy the said position.

       ARTICLE 49             VETTING COMMITTEE 

  1. There shall be a Vetting Committee which shall be chaired by the Electoral Commissioner and shall be responsible for ensuring that candidates for any election satisfy the requirements provided for in this Constitution, or a resolution of the General Assembly, or any other regulation which may be set out by the Electoral Commission. 
  2. The composition of the Vetting Committee shall be: 
    1. The Chairperson of the Electoral Commission; 
    1. One (1) deputy Chairperson; 
    1. Two (2) General Assembly members; 
    1. One (1) member of the Executive Committee; 
    1. Three (3) other students invited by the Electoral Commissioner.  
  3. The Vetting Committee shall have the power to disqualify any candidate (s) if: 
    1. They do not meet the minimum qualifications set for the election; 
    1. There has been a ruling by a court of competent jurisdiction  which finds him or her guilty for any criminal or civil offence;  
    1. There has been any ruling: 
      1. So made by the Disciplinary Committee, the Judicial Council, or the General Assembly against such a candidate, which finds him or her guilty for a wrong doing; or  
      1. Any other adverse finding (s) so made by a commission or committee of the SRC which confirms the criteria in c (i) above to that effect. 

       ARTICLE 50             OTHER RULES AND REGULATIONS ON ELECTIONS 

  • A person can be deemed a candidate only after he/she has been vetted and put up by the Electoral Commission as eligible for election. 
  • A person put up as a candidate may withdraw his/her candidature not later than Five (5) days before the election. (Reason for the change from 1 to 5 days: a day’s withdrawal will constrain the EC in a case of having to re-open nominations) 
  • A candidate who wishes to withdraw his candidature may do so by formally writing a letter to the Electoral Commission to that effect. 
  • Complains of electoral fraud and allegations of electoral malpractices, as well as petitions challenging the legality of an election, should be lodged with the Judicial Council and copied to the Electoral Commission, within Forty-Eight (48) hours after voting. 
    • The Judicial Council shall sit on the case within Seventy-Two (72) hours after the receipt of the complaint, to decide on its merit or otherwise. 
    • Without prejudice, the ruling of the Judicial Council shall be final and binding on all parties involved, or all parties as may be so affected. 

       ARTICLE 51             GENERAL QUALIFICATION FOR ASPIRANTS 

  1. A person shall not be a candidate for election unless:
    1. He/she is an undergraduate bona-fide student of GIMPA main campus.
    1. He/she has successfully completed three academic semesters (undergraduate), or two semesters (top-up student), and has at least one more academic year to complete his/her programme of study.
    1. He/she has paid all school fees in full before filing for any position.
    1. He/she files and lodges with the Electoral commission, nomination papers which are:
      1. Signed by him/her and his/her running mate in case of candidates

contesting jointly and signed individually in the case of a candidate contesting independently;

  1. Signed by ten (10) students made up of five (5) General Assembly  members and Five (5) non General Assembly members.
    1. He/she is a student in good standing:
      1. He/she has not been found guilty by the SRC Judicial Council or

 GIMPA’s Disciplinary Committee on any charge.

  1. He/she has not been found guilty by any Court of competent Jurisdiction.
    1. A student who holds any Executive position must resign his/her office within twenty-one (21) days prior to the elections, in order to be eligible to contest for any position. 
  2. All aspiring Candidates must have observed General Assembly proceedings at least three (3) times prior to the elections, and must have considerable experience on SRC activities.
  3. The presidential and vice presidential positions, shall be jointly contested under the presidential ticket.
  4. The SRC Treasurer position shall be contested by students who have some considerable background in Finance or Accounting from GIMPA, or any other recognized academic institution.  
  5. For purposes of clarity, the position of Womens’ Commissioner shall be contested by only women. 

       ARTICLE 52             APPOINTMENT OF POLLING AGENTS 

  1. Each candidate fully certified by the Electoral Commission shall appoint as many polling agents as the Electoral Commission may determine, and forward their names to the Electoral Commission at least Forty-Eight (48) hours before voting. 
  2. The polling agents of all the candidates shall observe all proceedings on the day of elections:
    1. Electoral Commission and Electoral Officers shall empty all ballot boxes in front of all polling agents before the commencement of voting. All ballot papers, and their respective serial numbers, shall be verified by all polling agents before voting begins. 
    1. After close of polls, the Electoral Officers together with the polling agents shall convey the ballot boxes to a central point, where the counting of votes shall be observed by all. 
    1. Before counting begins, the Presiding Officer shall:
      1. State the total number of ballot papers issued. 

c) After the counting of votes, the Presiding Officer shall: 

  1. State the total number of votes cast; 
    1. State the total number of votes rejected; 
    1. State the total number of foreign materials found in the ballot box; 
    1. State the total number of votes cast for each candidate; 
    1. State and declare the provisional winners of the respective positions in   Question contested for.   

       ARTICLE 53             ELECTORAL OFFENCES  

  1. A person who commits an electoral offence shall be summoned before the Disciplinary Committee, and if found guilty, shall be given the appropriate punishment so prescribed.
  2. A person who-
    1. forges, fraudulently defaces, destroys a nomination paper, systems of voting or any other document, relating to an election, or delivers to a returning officer or the Electoral Commission any forged nomination paper; 
    1. Forges or counterfeits or fraudulently destroys a ballot paper or the official mark on a ballot paper; 
    1. Without authority supplies a ballot to any person; 
    1. Sells or offers to sell a ballot paper to any person or purchases or offers to purchase a ballot paper from any person; 
    1. Having no authority arising from this Constitution whatsoever, is found to be in possession of a ballot paper which has been marked with the official mark of the Electoral Commission; 
    1. Knowingly and intentionally puts into a ballot box anything other than the ballot paper which he is authorized by Constitution; 
    1. Without authority, destroys, takes, opens or otherwise interferes with a ballot box, ballot paper or packets of ballot papers in use or intended to be used for the purposes of an election; 
    1. Without authority, prints a ballot paper or what purports to be or is capable of being used as a ballot paper at an election; 
    1. Not being authorized to do so under this Constitution or regulations made under it, make a mark on a ballot paper issued to a person, other than himself, with the intent of increasing the margins of the votes cast in favour of a person; 
    1. Knowingly votes at an election at which he is not entitled to vote; 
    1. Votes more than once at an election:

Commits an electoral offence.

  • A person commits an act of impersonation if he/she:
    • Votes as another person, whether that other person is living or dead or is a fictitious person; or
    • Votes for a person whom he knows or has reasonable ground to believe to be dead or to be a fictitious person.

       ARTICLE 54             OFFENCES BY ELECTORAL OFFICERS 

1) An electoral officer, clerk, interpreter or any other person who has a duty to perform, whether under this or otherwise, in relation to an election, who: 

  1. Makes any record or enters any data which is required by this constitution to be made or of regulations made under it, which he/she knows or has reasonable cause to believe to be false;  
  2. Permits a person whom he/she knows or has reasonable cause to believe is not visually-impaired or challenged in any way, to vote in the manner provided for such persons; 
  3. Refuses to permit a person whom he/she knows or has reasonable cause to believe is visually-impaired or challenged in any way, to vote in the manner provided for such persons; 
  4. Willfully prevents a person from voting at a polling station at which he/she knows or has reasonable cause to believe the person is entitled to vote at; 
  5. Willfully counts a ballot paper as being cast for a candidate which he/she knows or has reasonable cause to believe was not validly cast for the said candidate; 
  6. Without reasonable cause, acts or fails to act in breach of his/her official duty: 

Commits an electoral offence. 

       ARTICLE 55             REQUIREMENT OF SECRECY

  1. Every person present at a polling station shall help maintain the sanctity and secrecy of every vote cast by not communicating any regarding voting pattern of electorates and respective candidates for whom a vote was cast on any particular ballot paper.
  2. No person shall:
    1. Interfere with or attempt to interfere with a voter when recording his vote;
    1. Obtain or attempt to obtain in a polling station information about the candidate for whom a voter in that station is about to vote or has voted for; 
    1. Communicate any time to any person, any information obtained in a polling station about the candidate for whom a voter in that station has voted or about the number, if any, on the ballot paper given to a voter at that station;
    1. Directly or indirectly induce a voter to display his ballot paper after he/she has marked so as to make known to another person, the name of the candidate for whom he/she has or has not voted for.
  3. A person who has undertaken to assist-
    1. a visually – impaired voter to vote; or
    1. A voter who is challenged in any way, to vote: 

Shall not communicate at any time to another person, information as to the candidate for whom that person intends to vote or has voted, or the serial number of his ballot paper.  

  • Any person who so contravenes any provision of this section commits an electoral offence. 

       ARTICLE 56             BRIBERY

  1. A person commits the offence of bribery:
    1. If he directly or acting through another person:
      1. gives money or obtain an office for a voter in order to induce the voter to  vote or refrain from voting;
      1. makes a gift or provides something of value to a voter to induce the voter  to vote in a certain way or to obtain the election of a candidate;
    1. If he advances or pays money or causes money to be paid to or for the use of a person with the intent that the money or part of it shall be expended in bribery at an election, or knowingly pays money wholly or in part expended in bribery at an election; 
    1. If after an election he directly or through another person receives money or valuable consideration on account of a person having voted or refrained from voting or having induced another person to vote or to refrain from voting.
  2. For the purpose of Clause (1):
    1. References to giving money include giving, lending, agreeing to give or lend, offering, and promising to procure or to endeavor to procure money or valuable consideration.

       ARTICLE 57             TREATING

1) A person commits the offence of treating-

  1. If he corruptly, either himself or through another person, before, during or after an election, gives or provides or pays wholly or in part, the expenses of giving or providing meat, drink, entertainment or provision to or for any person:
    1. For the purpose of corruptly influencing that person or another person to

 vote or refrain from voting;

  1. On account of that person or another person having voted or refrained

 from voting or being about to vote or refrain from voting.

  • If he corruptly accepts or takes any meat, drink, entertainment or provision offered in the circumstances for the purposes mentioned in paragraph (a) of this section.

       ARTICLE 58             INTERIM MANAGEMENT COMMITTEE 

  1. In the event of no election within the stipulated time:
    1. If the Speaker is still in school, he/she shall act as the interim President and shall head a five-member (5) Interim Executive Committee, which shall be appointed by the General Assembly at an Emergency General Assembly meeting called for that purpose. 

i. The Interim Management Committee shall conduct elections within twenty-one (21) days from the time of their appointment.

  • If the speaker is out of school, the General Assembly shall as a matter of urgency meet, and shall cause the Clerk or any of the old executives present and still in school to chair the meeting, to nominate a five-member (5)  Interim Management Committee.
    • The Committee shall appoint one person amongst them to act as its  Chairperson, with the mandate to conduct elections within twenty- one 

(21) days from the time of its appointment.

  1. The chairman of the Committee must not be a first or second year student.
  2. In case of an injunction on the Electoral process, the Interim Management Committee shall be tasked to conduct elections within twenty-one (21) days after the resolution of the injunction has been passed.

ARTICLE 59      NOMINATIONS OF INTERIM MANAGEMENT COMMITTEE                               MEMBERS 

  1. A person nominated must have been a General Assembly member for at least one (1) Academic Year.
  2. A person nominated must not be an aspirant or have the future ambition to aspire for any Executive position. 
  3. A person nominated must be of high moral character and proven intergrity. 

CHAPTER SEVEN

                             REMOVAL FROM OFFICE ARTICLE 60          GROUNDS FOR REMOVAL 

1) An Executive Committee Member shall be removed from office if found in accordance with the provisions of this Constitution:

  1. To have acted in violation of the Oath of Office, or to have violated the provisions of this Constitution;
  2. To be incapable or negligent and inefficient in the discharge of his/her duties;
  3. To have embezzled or misappropriated funds or recklessly handled the finance of the SRC;
  4. To have conducted him/herself in a manner likely to bring the high office of the President or Vice President or Secretary or Treasurer or Women’s 

Commissioner or SRC into disrepute, ridicule or contempt;

  • To have absented him or herself from three (3) General Assembly Meetings and Executive Meetings without prior permission and justifiable reasons in  writing to the Speaker;
  • In the case of the President:
    • if he absents himself from three (3) Executive Committee meetings, without permission and justifiable reasons to the Speaker; 
    • If he fails to appear before the General Assembly upon invitation or summoning.

       ARTICLE 61             REMOVAL OF A GENERAL ASSEMBLY MEMBER 

1) Any General Assembly member shall vacate his/her seat or cease to be a General Assembly member if:

  1. He/she is absent without prior permission, or without tangible reason (s) communicated to the Speaker in writing to that effect, prior to the absence.
  2. He/she is expelled from the General Assembly after having been found guilty of contempt of the General Assembly, or by the Disciplinary Committee upon a stated misbehaviour provided that such a member shall have the right of appeal to the Judicial Council, or by any ruling so made by the Judicial Council which finds such a person guilty.
  3. If the member in question so resigns from office as a General Assembly member by writing to the Speaker and copied to the Judicial Council.
  4. He/she so resigns in order to pursue further student leadership aspirations as far as the SRC is concerned.

       ARTICLE 62             IMPEACHMENT

  1. All impeachment proceedings shall be in writing and shall be referred to the Judicial Council, signed by two-thirds (2/3) of General Assembly Members, stating the reasons for the impeachment. 
  2. The written allegation referred to in clause one (1) above shall be accompanied by a statement of the detailed facts and all necessary documents supporting the claim for the impeachment.
  3. The Judicial Council upon receipt of the impeachment notice shall within two weeks: 
    1. Convene a meeting to investigate if there are any prima facie evidence for the removal of the said officer;
    1. The Officer (s) involved shall have the right to be heard in defense of the allegations, and the right to counsel; 
    1. The findings shall forthwith be submitted to General Assembly for ratification.
  4. After the submission of the findings, the General Assembly shall:
    1. Convene an Emergency meeting to pass a resolution, in which shall be required, a two-thirds (2/3) majority of General Assembly members present  voting yes, based on which the  Officer concerned shall cease to hold office with effect from the day on which  General Assembly passed the said resolution.
  5. In event of the entire Executive Committee being removed from office or resigning en-bloc, an Interim Management Committee shall exercise the functions until fresh elections are conducted within twenty-one days.

CHAPTER EIGHT

                             ADMINISTRATION ARTICLE 63           ADMINISTRATION 1. OFFICE SPACE 

  1. GIMPA authorities shall provide a space for SRC and it shall be noted as  the SRC Secretariat.
  2. Where the office is not accommodating enough for the executives, the  SRC shall secure additional space on campus for the Officers.

2. EQUIPMENTAND FURNITURE 

  1. The SRC shall provide furniture and office equipment for the day-to-day running of the Secretariat.
  2. The secretariat or SRC office must be equipped to project the image of GIMPA.

2) WORKING DOCUMENT 

  1. It is hereby declared that all official documents of the SRC shall be kept strictly under the care and custody of of the Executive Secretary.
  2. All archives shall also be kept at the SRC secretariat.
  3. The SRC shall operate a central filing system under the care of the SRC Executive Secretary.

3) INTERNAL COMMUNICATION 

  1. All communications within the SRC, and amongst SRC Executives and committee members, shall be done with an SRC MEMOORANDUM paper; no other paper shall be recognized as a working document.
  2. All Memoranda requesting for monies shall:

i.Be addressed to the SRC President; 

ii.Shall be stamped by the SRC Executive Secretary and forwarded back to the SRC President;

iii. The President shall then minute it to the SRC Treasurer for release of such funds.

4) EXTERNAL COMMUNICATION 

  1. All outgoing letters from the SRC Secretariat shall always be on the SRC letter heads and appropriate copies filed as well.
  2. All correspondences must be signed by the President or signed for him/her by the SRC Executive Secretary.
  3. All incoming mails must be handled by the Executive Secretary, and forwarded to the Officer (s) concerned.

5) SRC COMMITTEES 

  1. All SRC Standing or Adhoc Committees shall be given appointment letters, and these appointment letters shall be filed before the commencement of their work.
  2. In view of clause (a), all agreements shall be documented before the start of work.
  3. All minutes of the Executive Committee shall also be filed appropriately.

6) MINUTES OF GENERAL ASSEMBLY 

a) The minutes of the GIMPA SRC General Assembly meetings shall follow the high standards of votes and proceedings of the parliament of Ghana. 

7) THE STUDENTS FUND 

  1. There shall be an Account to be known as the SRC Accounts, into which all monies belonging to the SRC shall be paid.
  2. All monies collected by the SRC or any organization or committee under the SRC including clubs and associations, shall be deposited into the appropriate accounts, and under no circumstance shall any money be kept in an individual’s account.
  3. The SRC or its respective Committees shall retain an accountable impress, which shall be determined by the Executive Committee in consultation with the Finance Committee.

8)  WITHDRAWALS FROM STUDENTS FUNDS 

  1. No monies shall be withdrawn from any SRC account without the prior approval of the Finance Committee.
  2. The SRC shall operate a Current Account with the Ghana Commercial Bank Ltd or such other Banks as may be determined by a resolution of the General Assembly.
  3. Any receipt or withdrawal from the SRC fund by any document whatsoever shall be authenticated by the signatures of the Treasurer and the President.

9)  DUES AND AMOUNTS PAID BY STUDENTS 

  1. No amount shall be imposed on any student, unless such an amount is introduced by the Executive Committee, and is approved through a resolution of the General Assembly.
  2. For the avoidance of doubt, it is hereby declared that, SRC dues to be paid by the students shall be debated upon at the General Assembly before its imposition.

10) LOANS 

  1. No loan shall be raised for, or on behalf of the SRC or any committee otherwise, than by or under the authority of a resolution of the General Assembly.
  2. A resolution of the General Assembly passed in accordance with clause (a) of this article shall provide: 
    1. That the terms and conditions of the loan shall be presented to the General Assembly and shall not come into operation unless they have been approved by a resolution of the General Assembly;
    1. That any monies received in respect of that loan shall be paid into the SRC fund.

CHAPTER NINE

ARTICLE 64      STANDING ORDERS FOR MEETINGS 1. VOTING 

  1. Voting shall be for only accredited General Assembly members in case of General Assembly matters. 
    1. Every member is entitled to one vote.
  2. Voting shall be done by a simple majority of General Assembly members present, unless otherwise stated by the Constitution.
  3. Voting shall be by secret balloting in the case of:
    1. Formation of standing committees; 
    1. Electoral commission; 
    1. Impeachment; and 
    1. Any other matters which is politically inclined.
  4. Notwithstanding clause (c) above, all other voting shall be by show of hands, unless otherwise determined by the speaker of General Assembly.
  5. Voting privileges shall include the right of a member to make or second a motion or nominations.
  6. A working paper such as previous minutes shall be adopted before proceedings begin. 

However: 

  1. A motion can be used to introduce any relevant item to the agenda for discussion;
    1. Amend a stated agenda to include a new item for discussion. 

2. MOTIONS 

  1. Members of General Assembly have the right to file motions. 
  2. Observers shall have the right to file motions, however, such motions must:
    1. Be seconded by at least three (3) members of the General Assembly;
    1. Be in a written form; iii. Be addressed to the speaker.
  3. Motions shall not be opened for discussion unless: 
  4. It has been moved and seconded; and 
  5. The mover given the right to speak on the said motion by the Speaker.
  6. All motions shall: 
    1. Be verbal; or 
    1. Written; and 
    1. Must be addressed to the Speaker. 
    1. However, verbal motions shall be subject to the discretion of the Speaker.
  7. An issue shall not be discussed unless: 
    1. It concerns an approved agenda or subject under deliberation;
    1. It has been permitted by the House.

3. AMENDMENTS 

  1. Amendments shall be moved. All amendments so moved must follow the procedure of motions outlined in this Constitution.
  2. No amendment shall be moved, which by the Speaker’s ruling, rescinds, negates, or destroys the original motion.
  3. If an amendment is rejected, other amendments may be moved on the original motion. 
  4. If an amendment is carried out: 
    1. The motion as amended shall become the motion; 
    1. The motion as amended shall be the question to which any further discussion may be addressed; 
    1. The motion as amended shall be the motion upon which final vote shall be taken.

4. INTERVENTIONS 

  1. In addition to the discussions on an issue, the Speaker shall recognize those requesting the floor, by the following orders of precedence:
    1. Point of Order
    1. Point of Correction
    1. Point of Information
    1. Point of Personal Privilege
    1. Point of Interest
  2. A Point of Order
    1. Shall be heard at all times, except  during the act of voting; 
    1. Shall deal with the conduct of procedure of the meeting; 
    1. Shall concern only such matters in contravention of the Constitution, and shall call  attention to the introduction of a matter not applicable to the question under deliberation; 
    1. Can be used to dismiss a member who is naked.
  3. A Point of Correction shall concern factual presentation, which seeks to correct a statement made by the last speaker. It must be strictly related to the subject under immediate discussion.
  4. A Point of Information is a question or brief statement of a relevant fact, concerning the matter under discussion. It shall be directed to the Speaker.
  5. A Point of Interest is used to probe further into the issues under discussion.
  6. A Point of Personal Privilege is used to seek for permission, or for a personal interest.

5. ORDER OF PRECEDENCE (MOTION) 

  1. The Speaker shall allow the following procedural motions to be put, when there is already a proposition on the table in the following order or precedence:

i. Motion to withdraw motion; ii. Motion to recess;

  1. Motion to reverse the decision of the chair;
    1. Motion that a proposal should not be put now;
    1. Motion to expand or limit a debate to a specific time period;
    1. Motion to refer a matter to a committee;
    1. Motion to adjourn or postpone a mater to a later date;
    1. Motion that a motion should be voted upon.
  2. All procedural motions must be heard forthwith; they supersede all proceedings in the House. 

6. POWER TO MAKE BYE-LAWS 

  1. The General Assembly shall within its scope of authority under this Constitution, make bye-laws relating to matters under its control and power.
  2. All such bye-laws shall: 
    1. Be in writing; 
    1. Be subject to the scrutiny of the Judicial Council, and final approval of the General Assembly; 
    1. Come into effect when signed by the SRC President.

CHAPTER TEN

       ARTICLE 65             TRANSITION 

1) The transition period shall be before, during and after the handing over ceremony.

  1. Change of signatories to incoming executives shall be done at least three (3) days before the handing over ceremony.
  2. All necessary office keys and documents shall be handed over to incoming executive three (3) days before handing over.
  3. The outgoing Executives shall be responsible for giving the needed orientation to the incoming Executive Committee before handing over.
  4. The Outgoing Chairman of Finance Committee and the Outgoing Chief Justice shall take the incoming SRC President, Vice President and the SRC Treasurer round to inspect all movable and immovable Assets and Projects of the SRC before handing over.
  5. The incoming Executive shall take stock of the asset and report to the General Assembly immediately.

2) HANDING OVER 

  1. The outgoing Executives shall hand over to the incoming Executives at least Fourteen (14) days after the elections.
  2. The Outgoing Executives shall organize the ceremony in collaboration with the incoming Executives.
  3. The handing over ceremony shall be done in the presence of the majority of the students and GIMPA Management.

CHAPTER ELEVEN

       ARTICLE 66             INDEMNITY

  1. Members of SRC shall be reimbursed out of the SRC Fund against any indebtedness incurred exclusively for and on behalf of the SRC. Such indebtedness shall be proven to have been incurred in the legitimate use of office, and shall be in line with the execution of duties as specified under this Constitution or any resolution passed at the General Assembly. 
  2. The SRC Executive Officers, the Vice Secretary, the Speaker, the Clerk, the Chief Justice and the SRC Legal Advisor, shall be entitled to a monthly allowance which shall be determined by the Finance Committee subject to the approval of General Assembly. as part of the budget.
  3. All other Chairpersons of all Standing Committees shall also be entitled to monthly allowances which shall be determined by the Finance Committee subject to the approval of General Assembly.
  4. All Committees and its members shall be entitled to Sitting Allowances, provided there exists evidence of such meetings through their minutes and reports.
  5. General Assembly Members shall be entitled to sitting allowances which shall be determined by the Finance Committee and approved by General Assembly as part of the budget.
  6. Per Diem of an Executive or any person on errands for the SRC shall not exceed fifty percent (50%) of the Executive allowance; however, it shall be subject to the discretion of the Finance Committee, depending on the weight of the duty or distance travelled.

       ARTICLE 67             PROVISION OF HONORARIUM 

  • Certificate of Office shall be presented to members of the SRC upon the successful completion of their tenure in their respective capacities of service, by the SRC.
  • The Executive Committee members shall be given End of Service Benefits which shall be determined by the incoming Executives, subject to the Approval of the General Assembly.
  • The SRC shall honour students, lecturers, staff and non-teaching staff who may have made meaning contributions to the success of the SRC. 

CHAPTER TWELVE

       ARTICLE 68             AMENDMENTS AND REVIEWS 

  1. Any member of the General Assembly shall be entitled to propose an amendment to this Constitution.
  2. No amendment to this Constitution shall be proposed unless notice of such amendment is submitted in writing to the Judicial Council, signed by at least one hundred (100) supporters from among the students provided that twenty (20) signatories to the proposals shall be from each programme of study.
  3. The Judicial Council shall upon receipt of the proposal for amendment, schedule a preliminary hearing on the proposals for the amendment, and where satisfied that the conditions require an amendment of this Constitution, it shall give permission for such an amendment.
  4. The Judicial Council shall issue an order directing the Executing Committee to appoint a Commission with terms of reference purposely for the amendment of the Constitution.
  5. A Commission appointed under Clause four (4) of this article shall present draft proposals to the General Assembly for consideration.
  6. For the purposes of consideration and debate on the draft proposals, at least half of the total membership of the General Assembly shall be present and the vote of two-thirds (2/3) of such members shall be required to continue the process of amendment.
  7. The Commission shall publish the provisions intended to be amended together with the proposals for amendments and the draft provisions on all approved notice boards for at least twenty-one (21) days.
  8. The General Assembly shall vote on the proposed amendment, and if approved, a special public forum of the general student body shall be called for the purpose of acclamation for the amendment.

a. At least One Hundred (100) students must be present for the acclamation.

  • Where the proposal is approved, the new Constitution shall come into effect within seventy-two (72) hours after the student body has voted for the amendment.
  • Amendments to this Constitution shall be listed and annexed to this Constitution in the nature of amendments and shall be numbered in their order of creation, dated and gazette.

       ARTICLE 69               EXTERNAL AFFAIRS COMMITTEE  

  1. There shall be an External Affairs Committee which shall be responsible for the organization of students’ travels outside Ghana and other external affairs of the SRC
  2. It shall be responsible for the co-ordination of the SRC relationship with NUGS or other organizations or institutions. 
  3. The Chairman of the External Affairs Committee shall serve as the Local NUGS Representative  
  4. There shall be a Chairman and a Secretary to the Committee 
  5. The Chairman shall be the Chief spokesperson on NUGS affairs on campus 

CHAPTER THIRTEEN

ARTICLE 70      MICELLANEOUS 1) INVITATIONS TO PROGRAMMES 

  1. The Executive Officers in consultation with other members of the Executive Committee, shall have the power to nominate delegates, representatives or participants to any conference, seminars or projects to which the SRC has been invited. 
  2. The delegates, representatives or participants shall present written reports to the General Assembly. 
  3. The report shall be published by the SRC Secretary on all approved notice boards within a reasonable time after its submission to the General Assembly. 

2) REPRESENTATIONS TO NUGS PROGRAMMES 

  1. Without prejudice to any provision in this Constitution, delegations to NUGS Central Committee meetings, Annual Congresses and other functions shall include members of the Executive Committee or as may be so determined by the General Assembly. 
  2. The per diem allowance of General Assembly members attending NUGS Central Committee meetings and other Official meetings shall be borne by the SRC. 
  3. Without prejudice to clause (b) of this article, the capitation fee of General Assembly members for Annual NUGS Congresses shall be a charge on the Students’ Fund of the SRC. 

       ARTICLE 71             INTERPRETATIONS

  1. Resolution” means a resolution passed by the General Assembly and includes decisions;
  2. Article” means an article of this Constitution;
  3. Constitutional Instrument” means an instrument made under a power conferred by this Constitution
  4. Function” includes powers and duties
  5. Judgment” includes a decision, an order or: decree of the Judicial 

Council

  • Sitting” includes a period during which the General Assembly and other Committees meet continually  
  • Oath” includes affirmation specified in the Schedules of this 

Constitution

  • He” also means she whenever the issue in the Constitution affects a feminine gender.

       ARTICLE 72             COPIES OF THE CONSTITUTION 

  1. Copies of this Constitution shall be made available to every member of the Judicial Council, the Appeals Board, the Disciplinary Committee and the General Assembly during their swearing in.

a.  The copies given to such members will be the sole property of the SRC. 

  • The SRC Secretary shall cause to be kept in each library, copies of this Constitution for reference by any student.

CHAPTER FOURTEEN

SCHEDULE ONE THE PRESIDENTIAL OATH 

I ……………………………….. having been elected to the high office of the President of the GIMPA Students’ Representative Council do hereby in the name of the Almighty God swear (solemnly affirm) that I will be faithful and true to the SRC that, I shall strive at all times to preserve, protect and defend the Constitution of the SRC and I hereby dedicate myself wholly, without fear nor favour, to the service and welfare of the students of GIMPA in particular and of Ghana in General. 

I further solemnly swear (affirm) that I will conform to the principles of strict accountability financially and otherwise and that, should I at anytime break this my oath of office, 1 shall submit myself to the dictates of the SRC Constitution and suffer the penalty thereof (SO HELP ME GOD) 

SCHEDULE TWO THE VICE PRESIDENTIAL OATH 

I………………………………having been elected to the high office of Vice President of the GIMPA Students’ Representative Council do hereby in the name of the Almighty God swear (solemnly affirm) that l will be faithful and true to the SRC that I shall strive at all times to preserve, protect and defend the Constitution of the SRC and I hereby dedicate myself wholly, without fear nor favour, to the service and welfare of the students of GIMPA in particular and of Ghana in General. 

I further solemnly swear (affirm) that I will conform to the principles of strict accountability financially and otherwise and that should I at anytime break this my oath of office, I shall submit myself to the dictates of the SRC Constitution and suffer the penalty thereof (SO HELP ME GOD) 

 To be sworn before the out-going Chairperson of the Judicial Council at a public ceremony at which the officials of the College and the student body shall be present. 

SCHEDULE THREE THE SECRETARY’S OATH 

I…………………………………having been elected Secretary to the GIMPA Students’ Representative Council, do hereby in the name of the Almighty God swear (solemnly affirm) that I will at all times faithfully and truly serve the SRC in my capacity as Secretary, that I will support and uphold the principle of meticulous accountability financially and otherwise, that I will seek the welfare of the students of GIMPA in particular and the welfare of the students of Ghana in General 

I further solemnly swear (affirm) that should I at any time break this oath of office, I shall submit to the penalty prescribed by the SRC Constitution. (SO HELP ME GOD) 

 To be sworn before the out-going Chairperson of the Judicial Council at a public  ceremony at which the officials of the College and the student body shall be  present.

FIVE OATH FOR GENERAL ASSEMBLY MEMBERS

GIMPA Students’ Representative Council, do hereby in the name of the Almighty God swear (solemnly affirm) that i will bear true faith of allegiance to the SRC Constitution and uphold, preserve, protect and defend the’ SRC Constitution and expose with faithful zeal any act commission or omission or any other matter that would undermine the said SRC Constitution 

 To be sworn at the first general assembly meeting of the Assembly and administered by the SRC President

SCHEDULE SIX THE WOMEN’S COMMISSION’S OATH 

I…………………………………having been appointed as a member/Chairperson of the 

Women’s Commission, do hereby in the name of the Almighty God swear (solemnly affirm) that I will at all times faithfully bear allegiance and truly serve the SRC as established by law established; that I will uphold the sovereignty and integrity of SRC; and the institution as a whole; and I will preserve, protect and defend the SRC Constitution 

(SO HELP ME GOD) 

 To be sworn at the first General Assembly meeting and administered by the Chief Justice. 

SEVEN THE SPEAKER’S OATH 

I………………………..do hereby in the name of the Almighty God swear ,(solernn1y affirm) that 1 will bear the true faith and allegiance to the GIMPA Students’ Representative Council as by law established; that I will uphold the integrity of the SRC; that I will faithfully and conscientiously discharge my duties as Speaker of GIMPA SRC General Assembly and defend and uphold the Constitution of SRC; and I will do good to all manner of persons in accordance with this Constitution and the laws and conventions of the General Assembly without fear or favour, affection, or ill-will.. (SO HELP ME GOD) 

 To be sworn at the first General Assembly meeting and administered by the  SRC President 

EIGHT THE JUDICIAL OATH 

I……………………..having been appointed as a member of the GIMPA Students’ Representative Council Judicial Council, do hereby in the name of the Almighty God swear, (solernn1y affirm) that I will interpret the SRC Constitution, without fear nor favour, and to defend and uphold the Constitution and to adjudicate on all matters that shall be brought to the Judicial Council without affection, ill-will nor personal interest. I further solemnly swear (affirm) that, I shall not be found wanting in the discharge of my responsibilities as a member of the SRC Judicial Council nor place myself in such a position as to frustrate the efficient functioning of the said Judicial Council of the SRC.
